The Ault Firm represents a broad and diverse group of clients with regard to their real estate transactions. The Ault Firm’s real estate practice encapsulates all phases of real estate development, investment and operation. In line with the Firm’s “hands-on” philosophy, the Firm is often involved with a project from “cradle to grave”, assisting clients in entity formation, property acquisition, financing, entitlement, development documentation, management and construction documentation, lease-up, and asset disposition, along with other miscellaneous matters and transactions associated with the foregoing.
During the most recent downturn, Mr. Ault’s practice was heavily geared towards assisting clients in the acquisition of numerous non-performing notes, loan portfolios and REO properties from lenders. This representation included assisting in performing due diligence relative to loan files being acquired, title work, negotiating and drafting purchase and sale agreements, negotiating and documenting financing relating to such acquisitions, and advising clients regarding borrower work-outs and foreclosing out acquired non-performing loans, along with preparing and reviewing documentation associated therewith. As the non-performing debt and REO market emerged, Mr. Ault was able to draw off his experience with numerous disciplines to be uniquely positioned to offer the Firm’s clients with the expertise necessary to navigate the potential pitfalls found in transactions of this type.
The Firm is also involved in representing both landlords and tenants in all types of leasing transactions including residential, commercial, industrial, office, build-to-suit, and ground leases. The Firm also represents private lenders in financial transactions, preparing loan documentation, performing title work and coordinating escrows and closings. Additionally, Mr. Ault has been involved in numerous loan workouts representing developers, borrowers and guarantors in problematic real estate and business loans.
